How we handle course material, and how to report infringement.

1. How Course Material Is Used

Students upload their own program’s lecture material so PANCE Agent can quiz them on it. That material stays private to the student who uploaded it. It is never shared with other students, never shared across programs, and never used to build a shared question bank or any other product.

This is why every PA program must authorize PANCE Agent before its students can sign up. That authorization, the School Authorization Agreement, is the program’s permission for its students to use material the program or its faculty own with PANCE Agent. If a program withdraws it, uploading stops and the material its students uploaded is deleted within 90 days.

Uploaded material is not used to train any artificial intelligence model. Under their API terms, our AI providers do not train their models on it. See the Privacy Policy for the full list of service providers.

2. What We Ask of Students

Upload only your own PA program’s course materials or your own notes. Do not upload commercial question banks, textbooks, board-prep products, or any other third-party material you do not have the right to use this way.

Repeated infringement will result in account termination, as described in the Terms of Service.

3. Submitting a Copyright Infringement Notice

If you believe material on PANCE Agent infringes a copyright you own or represent, send a written notice to our designated agent:

PANCE Agent LLC’s designated agent is registered with the U.S. Copyright Office, registration number DMCA-1081959.

To be effective under 17 U.S.C. § 512(c)(3), your notice must include:

  • A physical or electronic signature of the copyright owner or someone authorized to act for them.
  • Identification of the copyrighted work claimed to be infringed.
  • Identification of the material claimed to be infringing, with enough detail for us to locate it.
  • Your contact information, including address, telephone number, and email address.
  • A statement that you have a good faith belief the use is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on the owner’s behalf.

When we receive a complete notice, we promptly remove or disable access to the material it identifies and tell the user who uploaded it, so they can send a counter-notification if they believe the removal was a mistake.

4. Counter-Notification

If your material was removed and you believe that was a mistake or a misidentification, you may send a counter-notification to our designated agent at the address above. It must include:

  • Your physical or electronic signature.
  • Identification of the material that was removed and where it appeared before removal.
  • A statement, made under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located (or, if your address is outside the United States, any judicial district in which PANCE Agent may be found), and that you will accept service of process from the person who submitted the original notice or that person’s agent.

When we receive a valid counter-notification, we send a copy to the person who submitted the original notice, and restore the material within 10 to 14 business days unless they tell us first that they have filed a court action to stop the activity.

5. Repeat Infringers

We terminate, in appropriate circumstances, the accounts of users who are repeat infringers.

6. Programs and Contact

For PA programs: to have specific material removed, send a notice to our designated agent as described in Section 3, and we will promptly remove it. To have all of your program’s material removed, withdraw your authorization: uploads stop immediately and everything your students uploaded is deleted within 90 days. Those are a program’s remedies for student-uploaded material under the School Authorization Agreement.
